AB - Migrations flows are not a brand-new phenomenon. Nonetheless, in these last  years,  the  findings  are  worrying.  In  fact,  at  the  end  of  the  year  2016,  a record was reached as the number of displaced people amounted to 65.6 million. In this connection, it must be stressed that the European continent has been particularly affected by this crisis. Bearing this in mind, we have to mention that some Member States of the European Union have adopted their own strategies, which -in some occasions- have deviated far from the position imposed by the mentioned international organization. At this juncture, it is relevant to examine the approach that the Court of Justice of the European Union  has  had  in  one  particular  case,  which  resulted  in  the  long-awaited  judgment rendered on September 6, 2017.
